We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and/or changes to our website. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes. It is your responsibility to check this page periodically for changes.

Service Terms

We reserve the right to refuse service to anyone for any reason at any time.

By agreeing to these Terms of Service, you confirm that you are at least 18 years old. To be registered as a User of this site, you must be at least 18 years old.

You may not use our Service for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

By agreeing to these Terms of Service you also agree to all rules and regulations that are imposed on our Service by the third parties involved in the payment processing, content hosting, operational support, and any other services and activities that are essential for this Service’s operations.

A breach or violation of any of the Terms will result in suspension and possible consequent termination of your Services.

Affiliations

We, as a Company and as a Service, do not affiliate ourselves with any political party, tribe, caste, clan, or society. We think of ourselves as of the international group of professionals that brings this Service to you for your pleasure and for our collective profit.

Profile and Account Termination

You can delete your profile and account at any time.

Upon account/profile deletion, the following will happen:

Subscribers: all subscriptions will be canceled immediately and no refunds for ongoing subscriptions will be issued whatsoever. Subscribers will not retain access to the subscribed material.

We can terminate or suspend your account/profile at any time at our discretion. We can also cancel any pledges and remove any content at our sole discretion with or without prior warning and/or explanation. However, in absolute majority of cases, we will contact you prior to the account/profile suspension/termination.

The reasons for account suspension or termination including, but not limited to, as follows:

Illegal Activities. This Service, as well as the company operating this Service, is governed by the laws of the United kingdom. Anything that is considered “illegal” by the UK law is illegal for use within our platform and will be removed/terminated.

Bullying. Any form of abuse, persecution, harassment, attacking, or bullying - within this platform or outside with the use of the platform or its parts - will lead to account suspension and investigation, which may result in subsequent profile/account termination.

Doxing. It is absolutely forbidden to aggregate and publish on this Platform any private personal or sensitive information of anybody, regardless of the fact if this person is our User or not, or reveal the identity of such an individual without the explicit written consent, for the purpose of intimidating aforementioned individual through harassment.

Private Information Abuse. Any usage (e.g. sharing, storing, selling) any private information, that became available to the User via this Platform, including, but not limited to, e-mail or home addresses, personal name, and any other data that can be considered “sensitive” or “private”, is strictly prohibited.

Content Sharing. Sharing somebody else’s content, that User got access to on this Platform, outside of this Platform without explicit permission from the original content owner is strictly prohibited.

Miscellaneous Sharing. Deliberate sharing of any encrypted, private, or other data related to the Service's operations, including but not limited to tokens, cookies, codes, passwords, as well as an unauthorized share of the correspondence between Service and its Users without explicit and direct permission from the Service, will lead to an immediate and permanent ban from the Platform.

Fraud. Publishing, endorsing, or selling any fraudulent or misleading information or transmitting any digital substance or a code of a destructive nature on this Platform will lead to investigation and potential permanent termination of the account with a report to the appropriate authorities. While this Service has no intentions to follow, curate, investigate, check up on or make and extensive research on vast information published on the Platform, we will take actions in case the investigation - for one or another reason - is initiated.

Impersonation. Presenting yourself as somebody else, especially well known and famous, leads to instant and permanent termination of the account, upon discovery.

Spam. A frequent posting of meaningless content - textual or audio/video - will lead to account suspension and investigation, which may result in subsequent account termination. We reserve the right to determine the meaningfulness of the published information.

Harm to this Service. Any unfriendly, offensive, obscene, derogatory, degrading remarks, public messages, comments or posts - within this Platform or elsewhere - that aim to offend, slander or attack our good name and reputation, or otherwise bring harm to this Service, the operating Company or its staff, members or partners, will lead to instant and permanent termination of the account, most likely followed by the legal actions against the perpetrator(s).

Misleading information. Any misleading information about the Service posted, reposted, or shared anywhere will cause instant and permanent termination of the account.

Dangerous Activities. Any User caught in the act or convicted of making credible violent threats, committing violent crimes, child abuse, violence against animals, malicious doxing, coordinating violent or nonviolent harm, participating in civil unrest, or encouraging others to do any of these activities, may be suspended/banned from using this Service. All activities that can put viewers in danger - by action or inaction - must include a clear disclaimer that warns against repeating such stunts.

Criminal Activities. People with a proven criminal history or with a known affiliation with violent or dangerous groups (e.g. organized criminal groups, terrorist or cyber-terrorist organizations, illegal militias, mercenary organizations, violent hate groups, etc.), won’t be onboarded and will be terminated upon discovery such activities, without regards to the declared purpose of the corresponding profile.

Inactivity. We reserve the right to suspend - with possible following termination, with our without prior notice - any content creator’s account/profile, that was inactive without prior notice - to us or to its Subscribers - for more than 30 days. All recurring billing will be paused. All collected pledges that are subject to payout will be processed within 30 calendar days upon payout request. In case when conditions for the payout are not met - all pledges will not be reimbursed whatsoever and will remain in the Service.

Deviations. We reserve the right to suspend - with or without prior warning - any content creator’s account/profile, that displays, hosts or advertises content that is drastically deviated from the type of content approved during the onboarding process.

Call to group actions. It’s strictly prohibited to ask anyone on the Platform - Subscribers - to request a refund, unsubscribe, leave Platform or initiate legal action against the Platform or participate in such actions.

Profile / Account Ghosting. It’s strictly prohibited to create an account/profile with the same, new, or altered credentials after an initial account/profile by this particular User was terminated, suspended, or otherwise disabled. For instance, if the profile "X" was terminated, it is prohibited to create a new profile "Y" by the same individual, organization, and/or any other associated entity.  

Violations of Acceptable Use. Usage will be monitored and violations of fair use, excessive downloads, or any attempts to bypass download limits are strictly prohibited.

These Terms remain in effect after your account is suspended, terminated, or otherwise disabled.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without the express written permission by us, unless we stated otherwise.

Recurring Billing

The subscription mechanism of this Service based on recurring billing.

The recurring charge dates vary based on the subscription date. The exact recurring billing date is determined by the Service at our sole discretion. Normally, recurring billing for each subscription runs roughly every 30 calendar days for each subscription instance.

We reserve the right to suspend a recurring billing for the following cases:

If any activity associated with the account and/or profile are considered suspicious. To determine transactions or activities are being suspicious, we may take into consideration any data provided to us by third parties or base our decision upon our own internal investigation.

Subscriptions

The subscription fee (i.e. price of monthly subscription) will be charged according to the billing model chosen upon subscription.

The number of payments paid by the Subscriber and the total amount depends on the first date of each billing cycle and settings, whether it should be paid instantly upon subscription or otherwise.

A monthly billing cycle can be defined as 28, 30, or 31 days regardless of the number of days in the following or current calendar month.

When a Subscriber changes the subscription tier, a new subscription is initiated, canceling the initial one. In other words, Subscribers pay as if they subscribe for the first time following the current billing model.

Every subscription has its own date and time, therefore multiple subscriptions will result in multiple charges, rather than in one batch charge.

Prices for subscriptions are subject to change without notice.

By becoming a Subscriber, you confirm that you use your own payment method that was issued in your name and belongs to you. Subsequently, you agree to comply with our payment processors’ rules and regulations in their entirety.

If and when our attempt to charge the current payment method fails, we will repeat such an attempt within the next few hours. When such attempts are unsuccessful, the selected payment method is deemed faulty and will be marked as such in the Payment Options section of the Account Settings page. To continue with the existing and future subscriptions, you will have to adjust a payment method by adding a previously used but updated credit/debit card. Alternatively, you can add a new card. As soon as this change happens, we will automatically repeat our attempts to charge your updated preferred payment method unless the recurring billing was disabled.

We may, at our sole discretion, limit or cancel subscriptions.

Unsubscriptions

The Subscriber can cancel a subscription (i.e. unsubscribe) at any time.

All access to paid content is lost after expiry of your subscription period if you do not maintain your paid subscription. To regain access, a new active subscription is required.

Upon subscribing again to the same profile - no matter how short the period of time was between unsubscription and re-subscription - the Subscriber will be charged full price for the new subscription according to the subscription price set on the profile.

Fees for Subscribers

There is no fee to start and run an account as a Subscriber with our Service.

You can cancel your pledge (i.e. subscription) at any time.

As a Subscriber, you will be charged a Subscription Fee instantly upon subscription. Thereafter, this fee will be debited from your preferred payment option on a monthly basis (roughly - every 30 days).

Depending on your location, some banks may charge you a Foreign Transaction Fee for your pledge, which will be assessed in addition to the pledge amount. The Foreign Transaction Fee is subject to change by the authorized institutions without prior notice. We have no control over this charge.

If you are located in the EU, then VAT is added to the final amount of the subscription. The exact amount of VAT is determined by the country you are a resident of and is shown when you set up the initial pledge amount.

The Platform handles collecting and paying out VAT.

Subscription Tiers

As a Subscriber, you can switch to a higher or lower Subscription Tier at any time.

If applicable, Subscribers are charged instantly upon switching tiers with the billing period is reset to the time of switching.

When switching from the lower to the higher tier, Subscribers pay the full price of the higher tier, not the difference between the original and new tier price.

When switching from the higher to the lower tier, no credit is given to Subscriber, i.e. the difference between tier prices is not credited to Subscriber’s credit card. Switching to a lower-priced tier immediately revokes access to all previously available content from a higher tier.

We reserve the right to limit or suspend orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate account information for all subscriptions and other pledges you make. You agree to promptly update your account and other information, including your e-mail address and credit card number and expiration dates so that we can complete your transactions and contact you as needed.

Certain content, products, and services available via our Service may include - partially or as a whole - content, products, and services produced, owned and maintained by third parties.

PREAMBLE

Multimodal generative models are being widely adopted and used and have the potential to transform the way artists, among other individuals, conceive and benefit from AI or ML technologies as a tool for content creation. Notwithstanding the current and potential benefits that these artifacts can bring to society at large, there are also concerns about potential misuses of them, either due to their technical limitations or ethical considerations.

You and Licensor agree as follows:

Definitions

"License" means the terms and conditions for use, reproduction, and distribution of the AI-Generated Images as defined in this document.

"AI-Generated Images" means the graphic files shared together with this document, that are the result of operating an AI-Model.

"AI-Model" means any accompanying machine-learning based assemblies (including checkpoints), consisting of learned weights and parameters (including optimizer states), corresponding to the model architecture as embodied in the Complementary Material, that have been trained or tuned, in whole or in part, on the Data, using the Complementary Material.

"AI-Sub-Model" means an AI-Model that contains information about a specific topic, like the description of a fictional or a real-life person.

"AI-Base-Model" means an AI-Model that contains sufficient information to generate various images based on text inputs.

"Input Images" means graphic files that are used during the generation of an AI-Model.

"dumbkoala.com Input Images" means graphic files provided via dumbkoala.com that were used to generate the AI-Sub-Model or AI-Sub-Models that were used during the generation of the AI-Generated Images under this license.

"Distribution" means any transmission, reproduction, publication, selling, or other sharing.

"Licensor" means the person or entity that is granting the License.

"You" means an individual or Legal Entity exercising permissions granted by this License.

"Third Parties" means individuals or legal entities that are not under common control with Licensor or You.

License Grant

The Licensor permits you to use the AI-Generated Images commercially and non-commercially, in accordance with the conditions set forth in this document and to the extent that the Licensor holds the right to do so.

Use Restrictions

You agree not to distribute the AI-Generated Images or make any other use of the AI-Generated Images if you do not own all applicable rights to the dumbkoala.com Input Images to permit their usage for AI-Sub-Model training. You grant permission to use the dumbkoala.com Input Images for AI-Sub-Model training to the Licensor.

You agree to distribute the AI-Generated Images only with a text on every image that informs the viewer, that all depicted persons are over 18 years old.

You make clear to the viewer of the image set, that all depicted persons are fictional characters based on characters designed for dumbkoala.com or dumbkoala.ai

You agree not to use or distribute the AI-Generated Images: In any way that violates any applicable national, federal, state, local or international law or regulation; For the purpose of exploiting, harming or attempting to exploit or harm minors in any way; To generate or disseminate verifiably false information and/or content with the purpose of harming others; To generate or disseminate personal identifiable information that can be used to harm an individual; To defame, disparage or otherwise harass others; For fully automated decision making that adversely impacts an individual’s legal rights or otherwise creates or modifies a binding, enforceable obligation; For any use intended to or which has the effect of discriminating against or harming individuals or groups based on online or offline social behavior or known or predicted personal or personality characteristics; To exploit any of the vulnerabilities of a specific group of persons based on their age, social, physical or mental characteristics, in order to materially distort the behavior of a person pertaining to that group in a manner that causes or is likely to cause that person or another person physical or psychological harm; For any use intended to or which has the effect of discriminating against individuals or groups based on legally protected characteristics or categories; To provide medical advice and medical results interpretation; To generate or disseminate information for the purpose to be used for administration of justice, law enforcement, immigration or asylum processes, such as predicting an individual will commit fraud/crime commitment (e.g. by text profiling, drawing causal relationships between assertions made in documents, indiscriminate and arbitrarily-targeted use).

Disclaimer of Warranty.

Unless required by applicable law or agreed to in writing, Licensor provides the AI-Generated Images on an "AS IS" BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, either express or implied, including, without limitation, any warranties or conditions of TITLE, NON-INFRINGEMENT, MERCHANTABILITY, or FITNESS FOR A PARTICULAR PURPOSE. You are solely responsible for determining the appropriateness of redistributing the AI-Generated Images and assume any risks associated with Your exercise of permissions under this License.

Limitation of Liability.

In no event and under no legal theory, whether in tort (including negligence), contract, or otherwise, unless required by applicable law (such as deliberate and grossly negligent acts) or agreed to in writing, shall any Contributor be liable to You for damages, including any direct, indirect, special, incidental, or consequential damages of any character arising as a result of this License or out of the use or inability to use the AI-Generated Images (including but not limited to damages for loss of goodwill, or any and all other commercial damages or losses).
